<p>Ultimately, one has to think the noble idea is going to fail and soon. All the old bitterness is rising again and there are now too many political factions involved. Not only do leaders have to negotiate a resolution, but they have to somehow sell it at home.</p>
<p>To understand the problem, look back a few years across the pond. The U.S. passed TARP to save itself and that was nearly impossible to do. That was just one Congress. On top of that, we now know Ben Bernanke had to pump 7 trillion dollars into the economy.</p>

This change is likely to maximize certainty and cash flow.</p>
<p>A second change is that &#8216;pay when certified&#8217; clauses have been abolished. It&#8217;s no longer lawful to make payment conditional upon performance under another contract. It&#8217;ll be unlawful for a sub-contract to contain a clause that states the sub-contractor only gets paid when the primary contractor&#8217;s application is authorized by the architect or engineer acting under the main contract. There is a limited exception for &#8216;management contracting&#8217;.</p>
<p>Following on from that, the adjudication rules have been changed to outlaw clauses that make one party liable for costs of adjudication no matter what the results. Additionally, a contractor can now request an extension of time for any period of valid suspension or delay such as winding down, which has enhanced their right to suspend performance for non-payment. The defaulting party is also forced to pay the contractor reasonable costs and expenses incurred in suspending performance.</p>
<p>The last adjustment is that the Construction Act has now been extended to cover contracts that are purely oral or only partially recorded in writing.
